A Moscow City Law draft “Of amending certain Moscow City Laws with regard to specification of requirements for
persons, holding state and municipal offices as well as offices of state and municipal
service”
On May 21, 2007 a Moscow City Law draft “Of amending certain Moscow City Laws with regard to specification
of requirements for persons, holding state and municipal offices as well as offices of state and municipal service” developed by specialists
of Institute of Asia and Pacific Region was submitted to The Moscow City Duma (Council).
The draft is aimed at amending nine Moscow City Laws:
- No 14-60 “Of status of the Moscow City Duma (Council) Deputy” dated July 13, 1994;
- No 23-73 “Of the Moscow City supervision and accounting Chamber” dated November 1, 1995
- No 43 “Of the Moscow City children Ombudsman” dated October 3, 2001
- No 10 “Of the Moscow City Statutory Court” dated February 13, 2002
- No 10 “Of status of elective officials for the Moscow City local authorities” dated February 25, 2004
- No 9 “Of status of the municipal Assembly deputy for the Moscow City municipal community ” dated February 25, 2004
- No 15 “Of the municipal service in the Moscow City” dated March 24, 2004
- No 3 “Of state civil service in the Moscow City” dated January 26, 2005
- No 43 “Of state offices of the Moscow City ” dated July 15, 2005
The necessity of these amendments is dictated by adoption of the Federal Law No 24 “Of amendments to certain legal acts of the Russian Federation concerning clarification of demands to persons, holding state or municipal offices as well as offices of state or municipal service” dated March 2, 2007.
To provide state security according to of Article 55, Part 3 of the Constitution of the Russian Federation and considering distinctive features of legal status of persons, holding state or municipal offices as well as to avoid the possibility for conflict of interests the Law draft suggests to limit the above mentioned persons in opportunities to carry on gainful activities, including scholastic, scientific and over kinds of creative efforts if it is financed by foreign states, international and foreign organizations, foreign and stateless citizens. It is suggested to prohibit indicated activities for state civil office workers and municipal office workers without written approval of the Head of correspondent office. The draft suggests prohibiting gainful activities if it is financed by foreign states, international and foreign organizations, foreign and stateless citizens for persons, holding state offices of the Moscow City. All exceptions may be determined by international treaty of the Russian Federation or by Federal
legislation.
The Law draft also introduces prohibition to be a part of control , tutorial and supervisory boards of foreign non-profit non-governmental organizations or their departments on the territory of the Russian Federation (excluding issues determined by international treaty of the Russian Federation or by Federal legislation ) for persons, holding state and municipal offices of the Moscow City as well as state and municipal office workers of the Moscow
City.
